On the Internet, your actions are viewed as representative of not only you personally, but of TerraCom, Inc. as well. Actions of individual users can have a negative impact on every other user. We ask that you, as our user, do your best to be courteous, polite, and responsible. The following are some policies that will help to clarify your responsibilities on the Internet.

Under no circumstances are any TerraCom accounts to be used for illegal activity. Any account found to be using the TerraCom gateway for illegal purposes would be immediately suspended until the systems administrator can complete a thorough investigation. Subscribers found guilty of such activities will have their accounts terminated. Additional legal action may also be taken.

Users agree to comply with all copyright laws. Users who violate copyright laws will have their accounts terminated as detailed in the "Digital Millenium Copyright Act."

Harassment will not be tolerated in any fashion. Harassment is defined as any repeated, willful, malicious action against another subscriber, network representative, or Internet user. Harassment by our definition includes SPAM (unsolicited, bulk email). TerraCom reserves the right to determine whether a specific action or group of actions is harassment. We reserve the right to terminate offenders account without notice if we feel that there is reason to do so.

Under no circumstances are these accounts to be used by any other entity or resold in any way. Additional email accounts may not be used simultaneously.

The Internet is as diverse as the real world. It is not possible for TerraCom to monitor or filter the information made available through the TerraCom gateway, neither is it the policy of TerraCom to screen information for potentially offensive material. TerraCom takes no responsibility for the content of information located on the Internet through one of its accounts. TerraCom shall in no way be held responsible for material found through the use of its facilities. Additionally, TerraCom is in no was responsible or liable for any material which originates from its users: your posts (USENET or web pages, etc.) and emails are your responsibility.

The views and opinions represented on TerraCom through its newsgroups, World Wide Web pages, mail, posts, or discussion groups are not necessarily the views of TerraCom or its staff. TerraCom shall in no way be held liable for the use or reliance on information obtained through TerraCom accounts and services or from any damages that may occur from said use or reliance. Under no circumstances is the subscriber to deliberately damage, overload, or sabotage TerraCom hardware or facilities. Any such action discovered by a system administrator will result in the immediate termination of that subscriber account, legal action and a public statement concerning that activity to other providers.

TerraCom reserves the right to freeze an account for any reason, at any time, and without notice to any subscriber. Should such a freeze take place, the subscriber will be notified within 48 hours as to the reason for this suspension.

The sending of email to large numbers of users who have not requested information ("spam") and the posting of a message to multiple newsgroups in Usenet news are considered to be abusing the Internet and will not be tolerated. To make commercial information available on the Internet, the use of the World Wide Web is the recommended medium; an occasional news post in Usenet newsgroups where your message is on topic for that group is also acceptable. Failure to abide by these standards for news or email will result in the suspension of the account from which the offense originated.

Each dial-in account comes with a shell account. This account is used to store email and minimal downloads. This account may NOT be used to support individual web pages. Downloads greater than 2 MB of space are greatly discouraged. Any downloading that interrupts normal server activity will result in the suspension and possible termination of the account. TerraCom reserves the right to delete, without notice, any files deemed necessary to maintain the smooth operation of its servers in the event a user is using more than 2 megs of space.

TerraCom reserves the right to disconnect any connection that is inactive for fifteen minutes or more and disconnect any non-dedicated connection that has been maintained for over two hours during peak periods.

TerraCom's Technical Support expertise lies in Dial-up connection problems, this is limited to configuring dialers, email software, and web browsers. For all other issues, we recommend contacting the hardware manufacturers or software distributors. You can email Technical Support at help@terracom.net. Phone support is available. Phone calls are returned in the order received. E-mail is returned within two business days.

Disk space quotas may be increased by contacting TerraCom. When bandwidth quotas are exceeded at any time with a monthly billing cycle, the client will be billed at the current rate for additional bandwidth.

Payment is due at the beginning of each billing period. Late payment may result is suspension without notice.

The integrity and backup of all Web-pages and email communications is the clients responsibility. TerraCom shall not be held libel for any losses of content from our servers for any reason what so ever including human error, acts of God, hardware or software failure, vandalism or other causes.

By being a TerraCom client you agree to indemnify and hold harmless from and against any and all costs, claims, liabilities, expenses and damages (including reasonable attorneys' fees and accountants' fees) resulting from the imposition of any action of any kind against or on the behalf of you, your family, associates or business or other relationships.
